Agreement between you and Thrust CRM

1. Acceptance of Terms

By accessing or using Thrust CRM ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all users, including visitors, subscribers, and others who access or use the Service.

2. Description of Service

Thrust CRM is a cloud-based customer relationship management platform that provides:

  • Contact and company management
  • Marketing automation and workflows
  • Live chat and messaging (SMS/WhatsApp)
  • Form builders and email tracking
  • Multi-tenant/agency features (Enterprise plans)
  • Integrations with third-party services
  • Analytics and reporting tools

3. Account Registration

3.1 Eligibility

You must be at least 18 years old and legally able to enter into contracts to use the Service. By creating an account, you represent that you meet these requirements.

3.2 Account Information

You must provide accurate, current, and complete information during registration and keep your account information updated. You are responsible for:

  • Maintaining the confidentiality of your password
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

3.3 One Account Per Person

Each individual may maintain only one active free trial account. Organizations may have multiple team members under a single paid subscription.

4. Subscription Plans and Billing

4.1 Free Trial

We offer a 14-day free trial with full access to features. No credit card is required. At the end of the trial, you must subscribe to continue using the Service.

4.2 Paid Subscriptions

  • Starter: £29/month or £290/year
  • Professional: £79/month or £790/year
  • Enterprise: £199/month or £1,990/year

Prices are subject to change with 30 days' notice. All prices exclude VAT (20% added for UK businesses).

4.3 Payment

Subscriptions are billed in advance on a monthly or annual basis. Payment is processed securely by Stripe. You authorize us to charge your payment method at the start of each billing period.

4.4 Automatic Renewal

Subscriptions automatically renew unless you cancel before the renewal date. You can cancel anytime from your account settings.

4.5 Refunds

We offer a 30-day money-back guarantee. If you're not satisfied, contact us within 30 days of your first payment for a full refund. Subsequent months are non-refundable.

5. Acceptable Use Policy

You agree not to use the Service to:

  • Violate any laws or regulations
  • Send spam or unsolicited commercial messages
  • Upload malware, viruses, or harmful code
  • Harass, abuse, or harm others
  • Infringe intellectual property rights
  • Impersonate others or misrepresent your identity
  • Access others' accounts without permission
  • Interfere with or disrupt the Service
  • Reverse engineer or attempt to extract source code
  • Resell or redistribute the Service (except Enterprise partners)

6. Your Data

6.1 Ownership

You retain all rights to the data you store in Thrust CRM. We claim no ownership or intellectual property rights over your content.

6.2 License to Use

You grant us a limited license to host, store, and process your data solely to provide the Service. This includes backing up your data and allowing authorized team members to access it.

6.3 Data Responsibility

You are responsible for:

  • The accuracy and legality of data you upload
  • Obtaining necessary consents from your contacts
  • Compliance with data protection laws (GDPR, PECR, etc.)
  • Maintaining your own backups (we provide automated backups but recommend keeping copies)

6.4 Data Deletion

When you close your account, we delete your data within 30 days, except where retention is required by law.

7. Intellectual Property

7.1 Thrust CRM Property

The Service, including all software, designs, text, graphics, logos, and trademarks, is owned by Thrust CRM and protected by UK and international copyright and trademark laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes, subject to these Terms.

7.3 Feedback

If you provide feedback, suggestions, or ideas, we may use them without obligation or compensation to you.

8. Availability and Support

8.1 Uptime

We aim for 99.9% uptime but don't guarantee uninterrupted access. The Service may be unavailable due to maintenance, updates, or factors beyond our control.

8.2 Support

  • Starter: Email support (48-hour response)
  • Professional: Priority email support (24-hour response)
  • Enterprise: Dedicated support manager, 24/7 phone support

9. Termination

9.1 By You

You may cancel your subscription anytime from your account settings. You'll retain access until the end of your billing period.

9.2 By Us

We may suspend or terminate your account if you:

  • Violate these Terms or our Acceptable Use Policy
  • Fail to pay fees when due
  • Use the Service in a way that harms us or others
  • Engage in fraudulent activity

We'll provide notice when possible, but may suspend immediately if necessary to protect the Service or other users.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We don't warrant that the Service will be error-free, secure, or uninterrupted. You use the Service at your own risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THRUST CRM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months before the claim arose, or £100, whichever is greater.

12. Indemnification

You agree to indemnify and hold Thrust CRM harmless from any claims, damages, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your data or content

13. Governing Law and Disputes

13.1 Governing Law

These Terms are governed by the laws of England and Wales.

13.2 Dispute Resolution

We prefer to resolve disputes amicably. If you have a concern, please contact us at legal@thrustcrm.com.

If we can't resolve the issue, disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to Terms

We may update these Terms from time to time. We'll notify you of material changes by email or through a notice in the Service. Continued use after changes constitutes acceptance.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and other referenced policies, constitute the entire agreement between you and Thrust CRM.

15.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

15.3 No Waiver

Our failure to enforce any right or provision doesn't constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.
